#30 District Court of Oregon State declares Parental Authority:
These programs that are funded with hundreds of thousands of dollars of taxpayers money are in violation of Oregon’s Revised Statute: 336.067 which states: “Special emphasis shall be given to instruction in honesty and morality and respect for parents and the home.” These programs are immoral and shall be held unconstitutional. (1984) District Court Judge Noel fox expressed it very well in 1978 ruling in Federal district Court in Western Michigan: “Parental authority is plenary (complete).
It prevails over the State, other outsiders, and the children themselves. There must be some compelling reason for interference. It needs no further discussion to conclude that the right of parents to the care, custody and nurture or their children is of such a character that it can not be denied without violating these fundamental principles of liberty and justice which lies at the base of all our civil and political institutions.
Parents rights in this case are guaranteed by the first, fifth, ninth and fourteenth Amendment of the United States Constitution. The Hatch Amendment: 20 US Code: a) s1232h “All instructional material, including teachers manuals, films, tapes or other supplementary instructional material which will be used in connection with any research, or experimentation program or project, must be and shall be available for inspection of the parent or guardian of the children engaged in such program or project.
This section of research means any program or project or any design to explore or develop new or unproven teaching methods or techniques. b) Protection of Pupils Rights: Inspected by parents or guardian, psychiatric or psychological examinations and testings: No student shall be required to submit to psychiatric or examination testing or treatment, political affiliation, or sex behavior and attitudes. Highlights:
698.4 Protection of Students Privacy: 1) parental consent and attendance 2) no personal or embarrassing questions about family 3) No intruding examinations of sex behavior and attitudes. 698.9 Even with parental consent parents must be notified and involved of conclusive findings.
